Reprint of the fifth and last edition. In Holdsworth's estimation, this study, first published in 1858, "has had a large influence on the later development of the subject. It owes the qualities which have given it this influence to the fact that Westlake combined his knowledge of the civilians with that of an English lawyer. He was able to use the technical learning of continental jurists, and to apply it with discrimination in the very different technical atmosphere of English law" (History of English Law XV:314). One of the field's greatest scholars, Westlake [1828-1913] was Whewell Professor of International Law at Cambridge, a founding editor of the Revue de Droit International et de Legislation Comparee and a founding member of the Institut de Droit International.
