Human rights in insolvency proceedings

This book is an English translation of a further developed and revised version of the doctoral thesis 'Insolventieprocedures en grondrechten' (Insolvency proceedings and constitutional rights), which Jan C. van Apeldoorn has defended on 2 December 2009 at the University of Tilburg. It discusses insolvency proceedings in the context of several international texts that address various aspects of fundamental and human rights, including the International Covenant of Civil and Political Rights, the European Convention for the protection of Human Rights and Fundamental Freedoms, the Universal Declaration of Human Rights, the Charter of Fundamental Rights of the European Union and further texts that address aspects of (international) insolvency proceedings, including the UNCITRAL Legislative Guide on Insolvency law, the UNCITRAL Model Law on cross-border Insolvency and the European Council Regulation on insolvency proceedings.
