Thoroughly Revised and Updated Textbook on the Transfer of Property Act

The Bare provisions of the Act have been rechecked so as to incorporate all the statutory changes. On the judicial side there has been a flood of cases on some of the topics covered by the Act. They include topics like ostensible ownership, fraudulent transfers, doctrine of lis pendens, part performance, mortgages and eviction suits. The courts have also examined the difference between settlement and Will and the effect of the change in relationship while the tenant is in possession. Same other new issues which came up for consideration were value of an unregistered sale deed, oral sales and social sale of mortgaged property, procedure for cancellation of sale deed, effect of EPF Act upon priorities, validity of an equitable mortgage created by deposit of certified copy of the original deed, installation of towers for wires, whether it creates the status of tenancy or licensee, effects of permissive occupancy, effect of subsequent events upon eviction notice, and distinction between grant and gift. Apart from these specific matters, almost every aspect of the Act has found new dimensions and new applications. The result is that comments in general have gone into the enrichment of commentary on every section.
