Due to the imminent accession by the European Union to the European Convention for the Protection of Human Rights and Fundamental Freedoms it has become ever-more important to ensure that both the procedures as well as the substantive application of European competition law by the European Commission and the EU Courts are consistent with the protection of fundamental rights set out therein.
